This assignment is due, printed in hard copy, by the start of class on Friday. No time in class will be given, either to work on it or to print it out. This is a voluntary assignment. A maximum of 6 points will be awarded for the assignment.

Your job is to read the following scenario, and explain why it is a grading listed. Then, you will think like a prosecutor, and explain what other alternative crime(s) could be offered to the jury in order to guarantee a conviction. Prosecutor’s offer every crime they feel they can prove occurred during the commission of the crime. If you believe there are other alternatives from a different chapter of the PA Crimes Code, offer them (potentially assault charges could accompany any homicide charge). Your response is to be written in two paragraphs – one to explain, one to offer alternatives with the reasoning behind the potential for these alternatives. Scenario
Kyle is messing around with Dylan. He knows he frightens Dylan with his constant threats, but this doesn’t stop him from continuing the harassment. Kyle comes to Springettsbury Park when he knows Dylan will be playing basketball. As he walks by the courts, Kyle makes sure Dylan sees the handgun Kyle borrowed from his dad, which is he wearing on his hip. Dylan’s older brothers are there, and they begin to harass Kyle for messing with their brother. Kyle becomes flusters and pulls the gun so he can scare them off and get out of the situation. In his confusion, he accidentally pulls the trigger, shooting Dylan’s friend Sam. Sam ispronounced dead at the Park.

Kyle will be charged with bringing a gun illegally on the grounds of Springettsbury Park. In addition, what is the most severe charge he will potentially face? What other charges could the District Attorney potentially place upon Kyle’s crime in an effort to gain conviction(s)?
